| Resumen en portugués brasileño: | Disserta acerca da família, ressaltando suas várias facetas durante o perpassar dos séculos. Debate a respeito do conceito desse instituto e da nova modalidade de entidade familiar aceita pela jurisprudência, contextualizando-os com a guarda compartilhada. Apresenta a divergência no que tange à natureza jurídica da família. Analisa historicamente o pátrio poder, desde sua formulação, na Roma Antiga, até sua moderna concepção, sendo então conhecido como poder familiar. Apresenta inúmeras nuanças desse instituto, dentre as quais, seu conceito, sua evolução na legislação pátria, os direitos e deveres dele provenientes, bem como as formas através das quais o poder público nele intervém. Discorre sobre o complexo instituto da guarda. Demonstra sua evolução no âmbito internacional, culminando no surgimento da guarda compartilhada, na Inglaterra, em meados do século XX. Demonstra como a guarda se desenvolveu no Brasil, realizando um estreito paralelo entre as mudanças sociais e jurídicas aqui ocorridas, até a promulgação da Lei 11.698/2008, a qual positivou a guarda compartilhada na legislação pátria. Comenta a guarda compartilhada antes do advento da lei que a instituiu, bem como o percurso legislativo que culminou na sua normatização. Analisa detidamente o instituto da guarda compartilhada, sobrelevando suas vantagens e desvantagens, bem como seus aspectos psicológicos e jurídicos. |
| Abstract: | Talks about the family, highlighting its various facets during permeates the centuries. Debates about the concept of the institute and the new type of entity family accepted by the jurisprudence, contextualizing them with Joint Custody. Shows the divergence with regard to the legal nature of the family. Examines the historical power of the father, since its formulation in ancient Rome, by its modern design and are then known as familial power. It presents many nuances of this institute, among them, its concept, its evolution in Brazilian legislation, rights and duties from him, and the ways in which the government intervenes in it. It discusses the complex institution of the custody. Shows their evolution in an international context, culminating in the emergence of Joint Custody in England in the mid-twentieth century. Demonstrates how the custody was developed in Brazil, performing a close parallel between the legal and social changes that occurred here, until the promulgation of Law 11.698/2008, which introduced the Joint Custody in the national legislation. Discusses the Joint Custody before the advent of the law that established and the legislative journey that culminated in his ruling. Closely examines the Joint custody, raised its advantages and disadvantages as well as their psychological and legal aspects. |
