| Resumo: | A Constituição Federal Brasileira diz ser fundamental a inviolabilidade do direito à vida. Garantir esse direito é um dever do Estado Brasileiro, o qual foi construído sob o fundamento da dignidade da pessoa humana, significando dizer que, junto à integridade física da pessoa, o Brasil deve proporcionar a cada homem uma vida digna. Diante disso, não podem ser elaboradas leis de conteúdo contrário a esses dispositivos, ou seja, é inconstitucional e, portanto, proibido, texto legal que permita ou promova a eliminação da vida desde a concepção do ser humano. Nesse contexto, vedada, pela Constituição Federal Brasileira, está a aprovação de projeto de lei autorizando a realização do chamado aborto voluntário, uma vez que, para o Estado Brasileiro, qualquer atitude atentatória à dignidade e à vida humana representa a eliminação do próprio Estado, atingido em seu fundamento. |
| Abstract: | The Brazilian Federal Constitution says that it is fundamental the inviolability of the right of life. It Ensures this right is a Brazilian State’s duty of the, which was built on the foundation of human dignity, meaning that, along with the person’s physical integrity, Brazil must offer him/her a dignified life. Taking that into consideration, there can not be produced laws which contents go against such devices, that is to say unconstitutional and therefore prohibited, or legal text that will promote the elimination of life, starting from the conception of the human being. In this context, vetoed by the Brazilian Federal Constitution, is the adoption of law project authorizing the so-called voluntary abortion because, for the Brazilian state, any attack attitude on dignity and human life represents the elimination of the state itself, reached in his plea. |
