Abstract in Brazilian Portuguese: Realiza-se um estudo sobre o acesso à justiça ambiental no Brasil através de uma análise quantitativa e qualitativa de acórdãos do Superior Tribunal de Justiça em casos de conflitos ambientais. Para tanto, inicialmente se discute acerca da evolução das perspectivas filosóficas sobre a natureza no pensamento ocidental e os modelos ético-jurídicos do Direito Ambiental influenciados por elas, assim como o próprio ordenamento jurídico ambiental brasileiro. Em seguida, faz-se um percurso através dos conceitos teóricos de acesso à justiça e justiça ambiental, para depois se explorar os principais instrumentos processuais utilizados na proteção do meio ambiente. Por último, realiza-se a análise quantitativa e qualitativa de acórdãos do STJ, em conflitos ambientais, através da qual se conclui pelo caráter antropocêntrico do acesso à justiça ambiental no Brasil.
Abstract: This paper’s purpose is to investigate the access to environmental justice in Brazil by applying quantitative and qualitative analysis on court judgements from the Brazilian Superior Court of Justice about cases regarding environmental legal conflicts. In order to do so, initially it is discussed the evolution of philosophic views about nature on western thinking, the ethical and legal models of environmental law inspired by them, as well as the environmental Brazilian legal order. After that, there’s an overall study about the theoretical concepts of access to justice and environmental justice in order to explore the main instruments of legal process used to protect the environment. Finally, we explore the quantitative and the qualitative analysis of Superior Court of Justice judgments involving environmental conflicts, which concludes by the anthropocentric nature of access to environmental justice in Brazil.
