Resumo: Investigar se as limitações à realização do procedimento de esterilização voluntária estabelecidas na Lei de Planejamento Familiar coadunam-se com o direito ao livre planejamento familiar, previsto na Constituição de 1988. As restrições analisadas são a necessidade de anuência do cônjuge e a idade mínima de 25 anos ou ter dois filhos para a realização da cirurgia. Para que o objetivo do estudo fosse alcançado, este se baseou na pesquisa bibliográfica de livros, artigos científicos, dissertações de mestrado, além da legislação pertinente à temática. Primeiramente, investiga-se os fatores históricos que culminaram na previsão constitucional do direito ao planejamento familiar. Em seguida, analisa-se a Lei nº 9.263/96 e as restrições impostas à realização do procedimento, assim como a utilização da esterilização voluntária como método contraceptivo no Brasil. Ao final, estudam-se as Ações Diretas de Inconstitucionalidade nº 5097 e nº 5911, que tramitam no Supremo Tribunal Federal e questionam as restrições impostas pela Lei de Planejamento Familiar. Em função disso, é possível concluir que as restrições são descabidas e prejudicam, sobretudo, as mulheres, devendo o Estado abster-se de intervir na decisão de realização do procedimento de esterilização voluntária.
Abstract: It is investigated whether the limitations to the voluntary sterilization procedure established in the Family Planning Law harmonize with the right to family planning. The analyzed restrictions are the need for the spouse’s consent and the minimum age of 25 years or having two children to be able to perform the surgery. In order to achieve the purpose of the study, it was based on the bibliographic research of books, scientific articles, master's dissertations, and the relevant legislation to the subject. First, it is investigated the historical factors that resulted on the constitutional prediction on the right to family planning. Next, it analyzes the law nº 9.263/96 and the restrictions imposed to accomplish the procedure, as well as the use of voluntary sterilization as a contraceptive method in Brazil. At last, the Direct Actions of Unconstitutionality No. 5097 and No. 5911 are studied, each one of them is processed in the Federal Supreme Court and they also question the restrictions imposed by the Family Planning Law. As a result, it is possible to conclude that the restrictions are unreasonable and are especially harmful to women, and the State should refrain from intervening in the decision to carry on with the voluntary sterilization procedure.
