| Abstract in Brazilian Portuguese: | A presente monografia tem por objetivo a análise de dois importantes institutos no ordenamento jurídico pátrio, quais sejam, a súmula vinculante e a coisa julgada. Muito embora tais institutos trabalhem em favor da estabilidade das relações jurídicas, em algumas situações, acabam por apresentar comandos contrapostos, situação que trará a indagação: qual deles deverá prevalecer? Reconhecendo a impossibilidade de eleger resposta aplicável a todo embate jurídico por eles protagonizado, focalizamos a análise no enunciado vinculante de nº 4, editado em abril de 2008, na intenção de, pelo menos aí, oferecer resposta satisfatória. |
| Abstract: | This work aims to analyze two important institutes of the national legal system, namely, the binding precedent and the res judicata. Although such institutes work in favor of the stability of legal relations, in some cases, they may end up presenting opposing commands, a situation that brings the question: which one shall prevail? Recognizing the impossibility of electing an applicable response to any legal battle by them protagonized, we focus on the analysis of binding statement nº. 4, published in April 2008, intending to offer, at least there, a satisfactory answer. |
