| Abstract in Brazilian Portuguese: | Analisa o instituto da adoção internacional, indo desde a problemática do conflito de leis, ou seja, qual lei é a aplicável ao caso específico (lei do domicílio ou da nacionalidade), até as delimitações impostas pelo nosso legislador ordinário a esse tipo de adoção, fazendo também uma abordagem detalhada da Convenção de Haia em matéria de adoção internacional. Antes, porém, faz um esboço histórico do instituto da adoção no âmbito internacional e interno, além de fazer uma análise dos diversos conceitos e da natureza jurídica do instituto. |
| Abstract: | It analyzes the institute of international adoption, from the problematic of the conflict of laws , in other words, wich law is the aplicable to the specific case (law of the domicile or from nationality ), to the delimitations impose by our ordinary legislator to this variety of adoption, and also an detailed approach of the Convention of Haia, in the matter of international adoption. Before that, however ,a historical delineation of the adoption institute in both international and internal spheres is made , in addition to an analysis from the several conceptions and from the judicial nature of the institute. |
